VideoFDB — Terms of Use
Anonymous submission, NeurIPS 2026 Datasets & Benchmarks track. Access to the Evaluation Dataset is governed by the NVIDIA Evaluation License for Video, Image or Audio Data (the “Agreement”), reproduced in full at /LICENSE. The summary below is provided for reviewer convenience; the full text of the Agreement is binding. 1. License grant and purpose
NVIDIA grants you a limited, non-exclusive, revocable, non-transferable, non-sublicensable license to internally use, reproduce, modify, and create derivative works of the Evaluation Dataset solely for the evaluation and benchmarking of AI Solutions (the “Purpose”). You may publish or otherwise disclose the results of your evaluation, subject to the restrictions in Sections 2 and 5 of the Agreement.
2. Limitations and prohibited uses
Except as expressly permitted, you may not:
- use the Evaluation Dataset for any purpose other than the Purpose; any commercial use, including training a machine learning model under a commercial license, is strictly prohibited;
- change or remove copyright or other proprietary notices;
- sell, rent, sublicense, transfer, distribute, offer, publish, or otherwise make the Evaluation Dataset (or any portion thereof) available to others, except as permitted in Section 5 of the Agreement;
- bypass, disable, or circumvent any technology limitation, encryption, security, DRM, or authentication mechanism relating to the Evaluation Dataset;
- use the Evaluation Dataset to identify or attempt to identify any individual in it, or combine it with any other dataset to profile or attempt to profile any individual;
- use the Evaluation Dataset to generate or simulate the likeness, appearance, voice, or other identifying characteristics of any individual, or to generate synthetic data, digital replicas, or any output with likeness to any individual in the Evaluation Dataset (except for regenerating the original audio-visual content for the Purpose);
- use the Evaluation Dataset to infer, measure, detect, or label race, ethnicity, gender, age, health, or any other sensitive attributes, or perform any biometric processing;
- use the Evaluation Dataset to develop or evaluate any identity-recognition technology;
- use the Evaluation Dataset in violation of applicable law, in any fraudulent, deceptive, defamatory, obscene, harassing, violent, or illegal manner, or to promote discrimination or hatred;
- use the Evaluation Dataset in any manner inconsistent with NVIDIA's Trustworthy AI Terms.
3. Ownership
The Evaluation Dataset, including all intellectual property rights, is and will remain the sole and exclusive property of NVIDIA or its licensors. NVIDIA and its licensors reserve all rights, interests, and remedies not expressly granted in the Agreement.
4. Personal data and deletion requests
The Evaluation Dataset contains personal data. Upon NVIDIA's request, you will cooperate with NVIDIA to honor any data-subject request for deletion or correction. If requested, you will delete all copies of the Evaluation Dataset and provide reasonably requested information to verify your compliance.
5. Distribution as part of academic publication
Notwithstanding the redistribution prohibition in Section 2(c), you may distribute or reproduce a minimal, illustrative portion of the Evaluation Dataset solely as part of an academic publication (peer-reviewed journal article, conference paper, thesis, preprint, or research-project website) that reports results derived from your use of the Evaluation Dataset, subject to all of:
- Minimal amount. Limited to the minimum reasonably necessary to illustrate, support, or validate the specific findings; not a substantial or independently usable portion.
- Non-commercial academic context only. The publication must be made available through a non-commercial academic or scientific channel.
- Attribution. Reproductions must (i) include a clear and conspicuous attribution to NVIDIA and David AI as the source of the Evaluation Dataset and cite the associated paper; (ii) identify the content as reproduced from the Evaluation Dataset under the Agreement; and (iii) state that further use, reproduction, or distribution of the Evaluation Dataset requires a separate license from NVIDIA or its licensors.
- Compliance. All restrictions in Sections 2(b) and 2(e) continue to apply, including the prohibitions on identification of individuals, generation of likenesses, and biometric processing.
Section 5 does not permit redistribution of the Evaluation Dataset as a standalone dataset or as separately downloadable supplementary files. Any distribution beyond Section 5 requires NVIDIA's prior written consent.
6. Feedback
If you provide suggestions, requests, fixes, modifications, enhancements, or other feedback regarding the Evaluation Dataset, you grant NVIDIA, its affiliates, and its designees a non-exclusive, perpetual, irrevocable, sublicensable, worldwide, royalty-free, fully paid-up, transferable license to use and exploit that feedback at NVIDIA's discretion. Feedback will not create any confidentiality obligation for NVIDIA.
7. Term and termination
The Agreement terminates automatically without notice if you fail to comply with any of its terms or commence or participate in any legal proceeding against NVIDIA with respect to the Evaluation Dataset. NVIDIA may also terminate the Agreement at any time on prior written notice. On any termination, you must immediately stop using and destroy all copies of the Evaluation Dataset and Derivative Works, and on request certify in writing that you have done so.
8. Disclaimer of warranties and limitation of liability
The Evaluation Dataset is provided as-is and with all faults. To the maximum extent permitted by law, NVIDIA disclaims all warranties (express, implied, or statutory) including title, non-infringement, merchantability, and fitness for a particular purpose. To the maximum extent permitted by law, NVIDIA will not be liable for any direct, indirect, special, incidental, or consequential damages arising from the Agreement or your use of (or inability to use) the Evaluation Dataset, even if advised of the possibility of such damages.
9. Indemnity, governing law, and trade compliance
You will indemnify and hold harmless NVIDIA and its affiliates, employees, officers, directors, and agents from all third-party claims arising out of or in connection with your use of the Evaluation Dataset.
The Agreement is governed by the laws of the United States and of the State of Delaware. Exclusive jurisdiction lies with the state and federal courts in Santa Clara County, California.
Trade compliance. You may not export, re-export, or transfer the Evaluation Dataset to any country, territory, entity, or individual subject to applicable U.S. export controls or economic sanctions, and you may not transfer, provide access to, or make the Evaluation Dataset available to any person or entity located in, or accessing it from, China, Russia, or Belarus.
10. Acceptance
The summary above is provided for convenience only. The full text of the Agreement at /LICENSE is the binding instrument. By clicking Continue to Dataset below, you confirm that you are an adult of legal age of majority in your jurisdiction and that you have read, understood, and agree to be bound by the NVIDIA Evaluation License for Video, Image or Audio Data in its entirety.
